Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Band Planned (the "Service"), operated by The Band Planned ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.

2. Your Account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

3. Subscription and Billing

The Service offers a paid subscription plan ("Pro") billed at A$9.99 per month or A$89 per year, in Australian dollars (AUD). A 14-day free trial may be offered to new subscribers. No payment details are required to begin the trial. The trial does not automatically charge you. To continue with a paid plan, you must choose monthly or annual billing and complete checkout. The paid subscription then renews at the selected interval until you cancel.

You can cancel your subscription at any time from within the Service. Cancellation stops future billing but does not entitle you to a refund for the current billing period except where required by applicable law. One active subscription covers a single band; other members you invite may use the Service at no additional charge. Lifetime licenses are no longer offered for purchase. Existing lifetime customers retain the access they purchased.

3A. Refer a bandleader

Share your personal referral link with a different bandleader. You earn one free subscription month when they open your link, create a new verified account and create their first different band or act within 30 days of that visit. They do not need to buy a subscription. Joining your existing band does not qualify.

One reward is available per referred account and separate band. Self-referrals, existing accounts, duplicate bands and fabricated accounts do not qualify. The first referral saved to the new account receives attribution. A band with the same name as the referring band, or shared membership between the two leaders, does not qualify.

Rewards stack and have no cash value. For monthly subscriptions, each reward credits one monthly payment. For annual subscriptions, it credits one-twelfth of the annual price, rounded to the nearest cent, towards renewal. Credits apply automatically to the next new subscription invoice and do not refund an invoice already paid. If you have not subscribed, earned rewards are saved for checkout. Complimentary and lifetime access have no subscription payment to discount; rewards remain saved if you later choose a paid subscription.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local law.
• Upload, store, or share content that infringes the rights of any third party.
• Attempt to access, disrupt, or compromise the Service's systems or another user's data.
• Scrape, reverse engineer, or resell the Service without our written permission.
• Use the Service to send unsolicited communications or spam.

5. Your Content

You retain ownership of any content you upload to the Service, such as files, setlists, recordings, and artwork. You grant us a limited licence to host, store, and display that content solely as needed to operate the Service for you and your band or act. You are solely responsible for the content you upload and for ensuring you have the rights to do so.

6. Intellectual Property

The Service, including its design, features, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary information.

7. Termination

You may delete your account at any time from within the Service. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your conduct harms the Service or other users. Upon termination, your right to use the Service ends immediately.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that gig or venue suggestions will result in bookings. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be resolved in the courts of South Australia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
